By downloading, installing, or using Daily (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years old.

3. App Description and Usage

The App provides features for:

• Tracking daily activities on a calendar
• Setting up and using workout timers
• Viewing your Apple Health activity
• Managing personal workout records
• AI-powered health and fitness chat assistance
• Premium subscription features for enhanced functionality

All data is stored locally on your device. The App does not create or maintain user accounts.

4. AI Chat Feature

4.1 Service Description

The AI chat feature allows you to:

• Ask questions about health and fitness topics
• Get insights based on your Apple Health data
• Receive personalized recommendations and information

4.2 Data Processing

• Your Apple Health data is processed locally on your device before being sent to our AI system
• All health data is anonymized and aggregated before transmission
• Chat conversations are processed through our secure infrastructure
• Your data is not used by OpenAI to train or improve their AI models

4.3 Usage Limitations

• The AI chat feature is subject to usage caps that may vary and change over time
• Usage limits are currently reset weekly on Mondays (this schedule may change in the future)
• Usage is measured by various factors including number of messages, message types, and response complexity
• When you reach your usage limit, you will not be able to send messages until the limit resets
• Usage caps may be modified at any time without prior notice

4.4 Accuracy and Medical Disclaimer

• The AI chat feature provides general information and should not be considered medical advice
• Always consult with qualified healthcare professionals for medical concerns
• The AI responses are generated based on general knowledge and your anonymized health data
• We do not guarantee the accuracy, completeness, or reliability of AI-generated responses
• You use the AI chat feature at your own risk

4.5 Content Restrictions

You agree not to use the AI chat feature to:

• Seek emergency medical advice or assistance
• Discuss self-harm or dangerous activities
• Share inappropriate or offensive content
• Attempt to circumvent usage limitations
• Input false or misleading health information

5. Subscription Services

5.1 Available Subscriptions

We offer the following subscription plans:

• Weekly subscription (includes free trial period)
• Annual subscription (includes free trial period)
• Subscription offering might change in the future

The AI chat feature is included as part of your premium subscription.

5.2 Free Trial

• Weekly subscriptions include a free trial period
• Annual subscriptions include a free trial period
• Free trials can be discontinued in the future
• Trial lengths may vary and are subject to change
• You will be charged the full subscription price after your free trial ends unless you cancel at least 24 hours before the trial period expires

5.3 Auto-Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• The cost of renewal will be the same as the original subscription price unless otherwise noted

5.4 Managing Subscriptions

• You can manage and cancel your subscriptions through your Apple ID account settings
• Go to Settings > [Your Name] > Subscriptions on your iOS device
• Cancellation takes effect at the end of the current billing period
• You will continue to have access to premium features until the end of your paid period

5.5 Pricing and Payment

• Subscription prices are set in US Dollars and may vary in other currencies
• Prices may vary by region based on local tax laws and currency exchange rates
• Payment will be charged to your Apple ID account
• Prices are subject to change with notice

5.6 Refunds

• All sales are final
• Apple handles all refund requests according to their standard refund policy
• You may request a refund directly from Apple through the App Store
• We do not provide refunds for unused portions of subscription periods

5.7 Consent to Share Consumption Data with Apple

By using our app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. We ensure that such data sharing is done in compliance with Apple’s policies and only as necessary to process your requests.

6. User Responsibilities

You agree to:

• Provide accurate information when using the App
• Use the App only for lawful purposes
• Not attempt to circumvent or disable any security features
• Not attempt to reverse engineer or modify the App
• Not use the App in any way that could damage or impair its functionality
• Not share your subscription access with others
• Use the AI chat feature responsibly and in accordance with these Terms
• Not attempt to circumvent usage limitations on the AI chat feature

7. Privacy and Data Collection

The App collects minimal data as described in our Privacy Policy. For the AI chat feature, your Apple Health data is processed locally and anonymized before transmission. All data handling practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual Property Rights

The App, including all content, features, and functionality, is owned by FitDaily.in and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the App without written permission.

9. Third-Party Services

The App uses third-party services for various functionalities:

• Apple App Store for payment processing
• RevenueCat for subscription management
• OpenAI for AI chat processing
• Firebase for analytics

These services have their own terms of service and privacy policies.

10. Service Availability and Modifications

• We reserve the right to modify, suspend, or discontinue any feature of the App, including the AI chat feature, at any time without notice
• AI chat feature availability may vary based on technical limitations or third-party service availability
• Usage caps and limitations may be changed at any time
• We do not guarantee uninterrupted access to any App features

11. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE. THE AI CHAT FEATURE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FITDAILY.IN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DAMAGES RESULTING FROM RELIANCE ON AI-GENERATED CONTENT OR HEALTH RECOMMENDATIONS.

13. Indemnification

You agree to indemnify and hold harmless FitDaily.in from any claims, damages, losses, or expenses arising from your use of the App, including your use of the AI chat feature or any actions taken based on AI-generated responses.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms within the App. Your continued use of the App after any changes constitutes acceptance of those changes.

15. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including violation of these Terms. Upon termination, your subscription will continue until the end of the current billing period.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
